Conditions of the FoodCity app with related savings programme

The following conditions apply to the use of the FoodCity app with the related savings programme. After registration of your account you must accept the conditions of this contract before you gain access to and can make use of the services.

Appèl pays a lot of attention to maintaining the information in this App. However, we reserve our rights regarding the accuracy of the information and are therefore not liable for any loss which directly or indirectly ensues from the use of the information. 

Appèl B.V.

Appèl B.V. and/or its legal successor(s), hereinafter also called: “Appèl”, is the organiser of the FoodCity app with the associated savings programme. Appèl’s head office is based at the address Mammoet 2, 5236 NV in ‘s-Hertogenbosch, The Netherlands.

The users can download the FoodCity app from the education institutions where Appèl applies the catering concept FoodCity.

Participation and registration

For participation in the savings programme it is necessary to download the FoodCity app. If this app is downloaded and the user has registered and can log in with his/her account, it is possible to participate in the savings programme. Downloading and creating an account is free.

Appèl respects your privacy and Appèl will endeavour to ensure that the personal information you provide to us is treated in accordance with the applicable privacy legislation.

Saving points

You can save points with the FoodCity app with earmarked purchases in our outlets, the completion of your profile and when participating in things like polls and quizzes. The following conditions apply:

  • When you spend €1.00 you will receive – if the digital customer card is scanned at the cash register – 10 points;
  • When you complete your profile, participate in a poll or quiz, you will receive 5 points;
  • Points are calculated on the basis of the net cash register amount, i.e. the purchase amount minus any discounts and/or discount coupons and naturally exclusive of deposit refunds;
  • Appèl can award extra points to certain purchases in the framework of promotional campaigns. The conditions for awarding will be announced with the promotional campaign in question. The points saved will be totalled, resulting in one points balance;
  • it is not possible to award savings points afterwards, i.e. after the purchase, if no digital customer card is scanned during the payment.

Saving points balance and cashing in savings points in coupons

The points balance is visible in the FoodCity app under ‘Rewards’. If there is any ambiguity about the points balance and how it was created, the Appèl records will be decisive. The accrued savings points can never be transferred.

You can exchange the accrued savings points for coupons under ‘Rewards’. ‘Rewards’ displays various items that you can save for. For each item it is described how many savings points you need and what discount you will receive. This can differ per item. Make sure to carefully read any additional information with these items.

You can find received coupons under ‘Coupons’ in the app. You will find an overview of the coupons here. Every coupon can have a different validity date. You can find the validity date of the coupon on the coupon itself.

The coupons cannot be exchanged for cash and can only be exchanged in combination with the digital customer card in the app, through which the coupon was acquired. The coupon cannot be cashed in without a digital customer card.

If a coupon has expired and/or a coupon is removed by the user, there will be no refund in cash or in the form of savings points.

Change and termination of savings programme

Appèl is entitled to at all times supplement, change and/or terminate the savings programme, the associated instructions and conditions in whole or in part.

This simply means that new savings programmes can be developed, geared to the needs of customers and/or clients of Appèl, or – if there is no longer a need for such – that savings programmes can be cancelled. This can also have consequences for the value of the savings points and the manner in which savings points can be cashed in.

Appèl will inform digital customer cardholders thereof in time via the FoodCity app. Appèl will give the customer cardholder at least 4 months to cash in the points already saved. This is only possible if the savings balance is higher than the minimum target balance applicable at that time. After the aforementioned term of 4 months the savings points will be cancelled.

Appèl has an obligation of endeavours with regard to taking care of maintenance, protection and functioning of the technical possibilities of the digital customer card in the FoodCity app. Appèl cannot, however, guarantee the completely error-free and uninterrupted functioning of the digital customer card in the FoodCity app. Appèl may transfer its rights and obligations under these User Terms to a third party. By accepting these User Terms the customer cardholder gives unconditional and irrevocable consent for such in advance.

The right to use the digital customer card in the FoodCity app will end in the following cases:

  1. the digital customer cardholder removes the account in the FoodCity app;
  2. termination in connection with a guideline or instruction of an authority, like a regulator;
  3. the digital customer cardholder has indicated in writing that he or she does not agree to a change in these general conditions;
  4. a legitimate interest justifies termination of the right of use;
  5. with immediate effect and without any notice of default if the digital customer cardholder does not perform the obligations;
  6. upon termination of the savings programme.

Deactivation of accounts:

– The Appèl App was especially developed for the students and staff of our catering locations. If you do not belong to this target group and you nevertheless create an account, we reserve the right to deactivate/remove your account.

– If an account has been created, but there is no activity with the app within two months, we reserve the right to deactivate/remove your account.

Liability

Appèl accepts no (direct or indirect) liability whatsoever for (unauthorised) use of and/or fraudulent actions of whatever nature with the digital customer card.

In case of suspicion of fraud or an act of fraud, acting in contravention of these conditions, abuse or other inappropriate behaviour by the digital customer cardholder and/or user, Appèl has the right to not provide the advantages connected with (the use of) the digital customer card and to block the digital customer card. Appèl can cancel the saved points in such case, without the digital customer cardholder being entitled to any compensation.

Changes in these conditions

Appèl can unilaterally change these conditions. As soon as Appèl makes substantive changes, Appèl will inform you, for example by means of a message in the app, by means of an e-mail or as soon as Appèl asks for your consent again.

Applicable law and competent court

The contract between Appèl and the digital customer cardholder with regard to the digital customer card and all (legal) transactions ensuing from the use of the digital customer card, these User Terms and every non-contractual obligation are exclusively governed by Dutch law.

All disputes which might arise from or in connection with these User Terms or in connection with contracts between Appèl and a digital customer cardholder, will exclusively be submitted to the competent court in ‘s-Hertogenbosch, The Netherlands.

Electronic communication

By registering for the App, you understand that Appèl can send you communications or information relating to the services, updates and promotional information and materials relating to the services, all in electronic form via the e-mail address that you provided when you registered. In the event we send such messages, you will be given the opportunity to be removed from the mailing list so that you will not receive future messages in accordance with the conditions of the Appèl Privacy Policy.

Copyright

Information from our App and in whatever form (texts, illustrations or software) may not be changed, reproduced, copied or distributed without the prior (written) consent of Appèl. Between the parties, Appèl is the owner of and it retains all rights, claims and interests in and to the App, website and/or service(s), including all intellectual property rights thereon.

Content and services linked to third parties

The App can contain functions and functionalities that link you to or provide you with certain functionalities and access to content of third parties, such as those of partners, including but not limited to websites, directories, servers, networks, systems, information and databases, software, applications, programmes, products and/or Services of third parties, and the internet as a whole. If you use a website or service of a third party that is linked to the App, your interaction will be with the third party and not with us. Such linked websites are not under our control and we are not responsible for the content of a linked website or a link in a linked website, or changes to or updates of such websites which are maintained by third parties. Placing a link to another website does not mean that we or our licensors approve that website (or one of the products, services or other materials that are offered via that website), regardless of whether the link is or is not linked to an offer that is included on our website.
